These Terms of Use (the "Terms") are a legal agreement between you and LYTEHOSTING LLC ("DocSwitch", "we", "us"), the company that publishes the DocSwitch mobile application, the docswitch.app website and the related cloud services (together, the "Service"). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who we are
LYTEHOSTING LLC, a Colorado limited liability company (Colorado Secretary of State ID 20231575159), 1500 N Grant St, Ste R, Denver, CO 80203, United States, is the company that publishes DocSwitch. You can reach us at support@docswitch.app.
The Service is offered worldwide. Where the law of the country in which you live gives you rights that these Terms cannot take away, those rights apply and prevail over any conflicting clause below.
2. What the Service does
DocSwitch converts, edits, scans, signs and manages documents. Tools marked "On-device" run entirely on your phone and your files never leave it. Tools marked "Cloud" upload the file you choose over an encrypted connection to our servers, process it, make the result available to you and delete every copy automatically within 60 minutes (sooner if you delete it yourself). Cloud files are scanned for malware before processing and are never read, indexed or used for any purpose other than producing your result.
The electronic-signature feature ("E-sign") lets you sign your own documents on your phone, have someone sign in person on your phone, or send a document to other people ("signers") so they can sign through a web link. Section 7 explains what E-sign is and is not.
The free version shows advertising and is limited to published daily allowances (shown in the app under "What's free, what's Premium" before any file is processed). A paid subscription or one-time purchase ("Premium") removes ads and raises or removes those limits (section 5).
3. Your account
DocSwitch creates an anonymous account for you: a random identifier generated by the app. We do not ask for your name, e-mail address or phone number to use the Service. Because the account is anonymous, we cannot recover it if you delete the app, reset your phone or delete the account; purchases are tied to your Apple or Google account and can be restored from the store (section 5).
You must be at least 13 years old to use the Service, or older where the law of your country sets a higher age for consenting to the processing of personal data (for example 16 in parts of the European Union). If you are under 18 you confirm that a parent or guardian has agreed to these Terms on your behalf. The Service is not directed at children.
To protect the Service against abuse, the app asks your phone's operating system to confirm that it is a genuine install from the app store (Google Play Integrity on Android, Apple App Attest on iOS) before cloud features are enabled. We do not receive any personal data from this check beyond a one-time cryptographic statement; see the Privacy Policy. A phone that fails this check can still use every on-device tool.
4. Your content and licence to us
You keep every right to the documents, images and other material you use with the Service ("Your Content"). We claim no ownership of it.
For cloud tools and E-sign only, you grant us a limited, worldwide, non-exclusive, royalty-free licence to store, copy, transmit, process and display Your Content solely as needed to provide the feature you asked for, for as long as it is needed for that purpose (at most 60 minutes for a conversion; for E-sign, the retention period in section 7). This licence ends when the file is deleted. We do not use Your Content to train machine-learning models, for advertising or for any other purpose.
You are responsible for Your Content. You confirm that you have the right to convert, edit, sign, share or request signatures on every document you use with the Service, and that doing so does not break any law, contract or third-party right (including copyright, confidentiality and data-protection rights of people mentioned in the document).
5. Premium: subscriptions, one-time purchases, trials, refunds
Premium is sold as auto-renewing subscriptions (weekly, monthly, yearly), as a one-time lifetime purchase and as consumable packs (for example a pack of cloud conversions). Prices, periods and any free trial are shown in the app before you buy, in the currency of your app-store account. Prices can differ by country.
All purchases are made through Apple's App Store or Google Play. The store, not DocSwitch, charges you, holds your payment details and issues receipts. Your purchase is subject to the store's own terms. We use RevenueCat, a subscription-management provider, to recognise your purchase across devices.
Auto-renewal: a subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. You cancel in your store account (iPhone: Settings → your name → Subscriptions; Android: Google Play → Profile → Payments & subscriptions → Subscriptions), not by deleting the app. Cancelling stops the next renewal; you keep Premium until the end of the paid period.
Free trials: where a plan offers a free trial, the trial length and the date on which the first charge happens are shown before you start it. Nothing is charged if you cancel before that date. One trial per store account. If you have used a trial before, the plan starts as a paid plan.
Refunds: because the store processes the payment, refund requests must be made to the store (Apple: reportaproblem.apple.com; Google: play.google.com/store/account/subscriptions or the Google Play refund form). The store decides under its own policy and the law of your country. We do not issue refunds directly. If you live in the European Union or the United Kingdom, you have a 14-day right to withdraw from a digital-content purchase; by starting to use Premium immediately you ask us to begin providing it at once and acknowledge that you lose the right to withdraw once the service has started, to the extent the law allows.
Restore: the app's "Restore purchases" button re-reads your purchases from the store if you reinstall or change phones on the same store account. A lifetime purchase stays valid for as long as the Service exists; it does not transfer between Apple and Google accounts.
Price changes: we may change Premium prices. For an existing subscription, the store notifies you in advance and, where the store or the law requires it, asks for your consent before the new price applies. If you do not agree you can cancel before the change takes effect.
6. Free allowances, ads and rewarded ads
The free version is limited (for example a number of finished documents per day, one cloud conversion per day, a number of signature requests per month and a cap on file size and page count). The exact numbers are published in the app and can change; the app always shows the current numbers before processing a file.
The free version shows advertising served by Google AdMob and, where required, only after you have given consent through the consent prompt. The app may offer to extend an allowance in exchange for watching a video ad ("rewarded ad"); the reward is granted only once the ad network confirms to our servers that the ad was watched in full. Attempting to obtain rewards or referral credit by automated means, repeated reinstalls, emulators or modified apps is prohibited and may lead to the loss of credits and termination.
Referral programme ("give a week, get a week"): when a friend installs DocSwitch with your invite code and completes a first document, both of you receive Premium days as published in the app. Credits are not money, cannot be transferred, sold or exchanged, have no cash value, and we may change or end the programme or withhold credits we reasonably believe were obtained by abuse.
7. Electronic signatures: what E-sign is, what it is not
E-sign produces simple (and, with identity checks, advanced-style) electronic signatures together with an audit record: who was asked to sign, which identity check they passed (e-mail or SMS one-time code, access code), when the document was viewed and signed, the signer's consent to sign electronically, and cryptographic hashes of the document before and after signing. Completed documents are sealed with a DocSwitch signing certificate and time-stamped.
E-sign is NOT a qualified electronic signature under EU Regulation 910/2014 (eIDAS), is not notarisation, and does not verify a signer's legal identity beyond the checks you choose. Whether an electronic signature is valid and enforceable for a particular document depends on the law of the countries involved and the type of document. Some documents are excluded from electronic signing in many countries, including wills and codicils, trusts, powers of attorney, family-law documents (marriage, divorce, adoption), court orders and filings, certain real-estate transfers and documents that require notarisation or witnesses in person. You are responsible for deciding whether E-sign is appropriate for your document and for obtaining any witness, notary or further formality the law requires.
DocSwitch does not provide legal advice. Nothing in the app, on the website or in our support replies is legal advice, and no lawyer-client relationship is created. If you need to know whether a signature will be valid or a contract enforceable, consult a qualified lawyer in the relevant country.
You are responsible for the documents you send, for choosing the right identity check for your signers, for sending requests only to people who have agreed to receive them, and for giving signers any notice the law requires before an electronic signature is used (for example consumer-disclosure rules under the US E-SIGN Act). Signers can decline, and a signer who declines or delegates is recorded in the audit trail.
Retention: the signed document, the signers' details and the audit trail are kept, encrypted, for the retention period shown when you create the request (30 days on the free plan, one year with Premium). After that the document and signature images are deleted; the audit record (which contains no document content) is kept until you delete your account, so that a dispute can still be answered. Download and keep your own copy of every completed document.
We provide E-sign and its audit records "as is". We do not guarantee that a court, authority or counterparty will accept a document signed with E-sign.
8. Acceptable use
You agree not to:
- use the Service for anything illegal, or to process, store or send material that is illegal, infringes someone's rights, is defamatory, or contains malware;
- use E-sign to impersonate anyone, forge a signature, sign on behalf of a person without authority, or send signature requests that are unsolicited bulk messages;
- interfere with the Service, bypass or probe its security, the device-integrity check, the allowances, the ad or referral rules, or access it with automated tools, bots, emulators or modified versions of the app;
- reverse-engineer, decompile or extract the source code of the app except where the law expressly allows it;
- resell, rent or provide the Service to third parties as a service of your own, or remove or alter any notice, label or watermark the Service adds;
- upload files that are not yours to process, or process documents containing other people's personal data without a lawful basis to do so.
We may suspend or end your access, delete Your Content from our servers and withhold credits if we reasonably believe you have broken these rules, and we may report illegal activity to the authorities.
9. Our intellectual property
The app, the website, our logos, names, designs, text, software and the DocSwitch signing certificate are owned by LYTEHOSTING LLC or our licensors and are protected by copyright, trademark and other laws. These Terms give you a personal, non-transferable, revocable licence to install and use the app on devices you own or control, under the app store's rules. All other rights are reserved. Open-source components are listed in the app under Settings → About → Licences and are governed by their own licences.
10. Privacy
Our Privacy Policy (docswitch.app/privacy) explains what we collect, why, how long we keep it and your rights. It forms part of these Terms. In short: on-device tools send us nothing; cloud files are deleted within 60 minutes; accounts are anonymous; crash reports are optional and contain no document content; you can export and delete your data from the app at any time.
11. Third-party services
The Service relies on third parties: Apple and Google (app distribution, payments, device integrity, push and system services), RevenueCat (purchase recognition), Google AdMob (advertising in the free version), Sentry (crash reports), and e-mail and SMS delivery providers for E-sign messages. Their services are governed by their own terms and privacy policies. We are not responsible for third-party services, app stores or networks, or for content on sites you reach through links in the Service.
12. Changes to the Service and to these Terms
We improve the Service continuously and may add, change or remove features, tools, allowances and prices. We will not remove a Premium feature you have paid for during a paid period without offering a comparable feature or a pro-rata refund through the store, where the law requires it.
We may change these Terms. For material changes we give at least 30 days' notice inside the app or on docswitch.app before they take effect, except where a change is needed to comply with the law or to address a security risk, in which case it may take effect immediately. If you keep using the Service after a change takes effect, you accept the new Terms; if you do not accept them, stop using the Service and, if you wish, delete your account. The date at the top of this page shows when the Terms were last changed.
13. Ending the agreement
You can stop using the Service at any time and delete your account and data from Settings → Account → Delete my account and data (see docswitch.app/delete). Deleting the account does not cancel a store subscription; cancel it in the store as described in section 5.
We may suspend or terminate your access if you break these Terms, if we are required to by law, or if we discontinue the Service. If we discontinue the Service entirely we will give reasonable notice where possible. Sections 4 (licence to us, for files still being processed), 7, 8, 9, 14, 15, 16 and 17 survive termination.
14. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law we make no warranties, express or implied, including of merchantability, fitness for a particular purpose, non-infringement, accuracy of conversions or recognised text (OCR), availability, or that the Service will be error-free or uninterrupted. Document conversion is not perfect: layouts, fonts and recognised text can differ from the original. Always check a converted or signed document before you rely on it.
Nothing in these Terms excludes or limits warranties or rights that cannot be excluded under the law of your country, including statutory consumer guarantees in the European Union, the United Kingdom, Australia and elsewhere.
15. Limitation of liability
To the fullest extent permitted by law, LYTEHOSTING LLC, its owners, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill, data, documents or the cost of substitute services, arising out of or related to the Service or these Terms, however caused and under any theory of liability, even if we were advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for Premium in the 12 months before the event giving rise to the claim and (b) USD 50.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct where the applicable law does not allow it to be excluded. Consumers in the European Union and the United Kingdom keep their statutory rights.
16. Indemnity
If you are a business user, you agree to defend, indemnify and hold harmless LYTEHOSTING LLC and its officers, employees and agents from any claim, loss, liability and expense (including reasonable legal fees) arising from Your Content, your use of E-sign (including claims by signers or counterparties), or your breach of these Terms or the law. For consumers this clause applies only to the extent permitted by the law of your country.
17. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State, Nigeria have jurisdiction over disputes, except that:
- if you are a consumer living in the European Union, the United Kingdom, Switzerland, Australia or another country whose law gives you the right to bring proceedings in your own courts under your own law, nothing in this section takes that right away;
- either party may seek injunctive or other urgent relief in any competent court to protect intellectual property or confidential information.
- Before starting any formal proceeding, please write to support@docswitch.app so we can try to resolve the matter informally within 30 days.
18. General
These Terms, the Privacy Policy and the in-app allowance page are the entire agreement between you and us about the Service. If any clause is found unenforceable, the rest stays in force. Our failure to enforce a clause is not a waiver. You may not transfer these Terms; we may transfer them to a successor of the Service with notice to you. The English version of these Terms is the binding version; translations are provided for convenience. Apple and Google are not parties to these Terms, but Apple and its subsidiaries are third-party beneficiaries of them and may enforce them against you, as the App Store terms require.
Export control: you confirm you are not in a country subject to a government embargo that prohibits the use of the Service and are not on any restricted-party list.
